Terms of Use

1. About UnyCars

UnyCars operates an online platform that connects people looking for automotive services with garages in their region of Québec. Clients submit a request describing their need, and garages that cover the relevant area and services are notified so they can respond. UnyCars is an intermediary only: we are not a garage, we do not perform automotive work, and we are not a party to any agreement reached between a client and a garage.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the platform. Garages must be legitimate businesses authorized to provide the services they offer in Québec.

3. Using UnyCars as a client

As a client, you can submit a request free of charge. You agree to provide accurate and complete information.

• The information in your request, including your contact details, will be shared with the garages matched to your request so they can contact you directly.
• Submitting a request does not create any obligation to choose a garage or to have work performed.
• Any quote, appointment, price, payment, warranty, or work is agreed directly between you and the garage, outside the platform. UnyCars is not involved in that relationship.

4. Using UnyCars as a garage (Pro)

As a garage, you receive leads matched to the areas and services you cover. You agree to:

• Provide accurate information about your business, coverage area, and services, and keep it up to date.
• Use the client information you receive only to respond to the relevant request, and handle it in accordance with applicable privacy laws.
• Be solely responsible for the quotes you provide, the work you perform, your prices, your warranties, and your compliance with all applicable laws, permits, and standards.
• Keep your account credentials confidential and remain responsible for activity under your account.

5. Fees and payment (garages)

Access to leads for garages is a paid service. The applicable fees, billing frequency, and payment terms are those communicated to you when you join the platform, or as updated from time to time.

• Fees may take the form of a subscription, a fee per lead, a commission, or a combination, as agreed with you.
• Payments are processed through a secure third-party payment processor. By providing payment information, you authorize us to charge the applicable fees.
• Unless stated otherwise, fees are exclusive of applicable taxes (GST/QST), which will be added where required.
• Because a lead is delivered as soon as it is sent to you, fees already paid are non-refundable except where required by law or expressly agreed.
• We may suspend access to leads if an amount remains unpaid after its due date.
• We may change our fees with reasonable prior notice; continuing to use the platform after a change takes effect constitutes acceptance of the new fees.

6. UnyCars' role and limits

UnyCars provides a connection service only. We do not guarantee that a client will receive a response, that a garage will receive leads, or that any transaction will result. We do not verify, endorse, or guarantee the quality, safety, legality, pricing, or outcome of any work performed by a garage, nor the accuracy of the information provided by clients or garages.

7. Acceptable use

You agree not to:

• Submit false, misleading, or fraudulent information, or requests you do not intend to pursue.
• Use the platform or the information obtained through it for any purpose other than the one intended, including unsolicited marketing.
• Attempt to access accounts, data, or systems without authorization, or disrupt the platform's operation.
• Use the platform in violation of any applicable law.

8. Intellectual property

The platform, including its content, design, trademarks, and software, belongs to UnyCars or its licensors and is protected by applicable laws. You may not copy, reproduce, or exploit any part of the platform without our prior written permission.

9. Disclaimer of warranties

The platform is provided "as is" and "as available", without any warranty of any kind, whether express or implied, to the extent permitted by law. We do not warrant that the platform will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, UnyCars shall not be liable for any indirect, incidental, or consequential damages, or for any dispute, loss, or damage arising from the relationship or the work between a client and a garage. Nothing in these terms limits liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify UnyCars against any claim, loss, or expense arising from your use of the platform, your breach of these terms, or, for garages, the services you provide to clients.

12. Privacy

The handling of personal information is described in our Privacy Policy, which forms part of these terms.

13. Suspension and termination

We may suspend or terminate access to the platform, in particular in the event of a breach of these terms or non-payment of fees by a garage. Garages may stop using the platform at any time, subject to any amounts owed up to the termination date.

14. Changes to these terms

We may modify these terms from time to time. The date at the top indicates the last revision. Significant changes will be communicated by reasonable means, and continued use of the platform after the changes take effect constitutes acceptance.

15. Governing law and language

These terms are governed by the laws applicable in the Province of Québec and the laws of Canada applicable therein. Any dispute will be submitted to the competent courts of Québec, unless the law provides otherwise. The parties have requested that these terms and all related documents be drawn up in French; an English version may be provided for convenience, and the French version prevails in case of discrepancy.
